2. Services Description

SKYLINE FUNDING CAPITAL LLC is a direct lender providing business funding solutions, including but not limited to:

• Working Capital Loans
• Revenue-Based Financing
• Business Growth Funding
• Short-Term Financing
• Equipment Financing
• Expansion Capital

We fund businesses directly from our own capital. We are not a broker, intermediary, or loan matching service.

3. Eligibility

To be eligible for our services, you must:

• Be at least 18 years of age
• Be authorized to represent and bind the business seeking funding
• Operate a legitimate business in the United States
• Provide accurate and complete information in all applications and communications
• Meet our underwriting criteria (which may vary by funding product)

4. Application Process

When you submit an application for funding:

• You authorize us to obtain your business and personal credit reports
• You authorize us to verify the information you provide
• You understand that submission of an application does not guarantee approval
• You agree to provide additional documentation as requested
• You acknowledge that we may decline any application at our sole discretion

All information provided must be accurate, current, and complete. Providing false or misleading information may result in denial of your application and potential legal action.

5. SMS Terms & Conditions

5.1 Consent to Receive Text Messages

By providing your mobile phone number and opting in to receive text messages, you consent to receive text messages from SKYLINE FUNDING CAPITAL LLC. Messages may be sent using an automatic telephone dialing system. Message frequency varies based on your account activity and our communications.

5.2 Types of Messages

5.3 Message Frequency and Costs

Message frequency varies. You may receive up to 10 messages per month, though this may vary based on your activity. Message and data rates may apply based on your mobile carrier's plan. Please contact your mobile carrier for details on your specific plan and rates.

5.4 Opt-Out and Help

You may opt out of receiving text messages at any time by:

• Replying STOP to any text message from us

After you send STOP, you will receive one final confirmation message, and then you will no longer receive text messages from us unless you opt back in.

Mobile carriers are not liable for delayed or undelivered messages. We are not responsible for messages that fail to deliver due to carrier issues, network problems, or other technical difficulties beyond our control.

If your funding application is approved:

• You will receive a formal funding agreement outlining all terms, rates, and fees
• You must review and sign the agreement before receiving funds
• Funding terms, rates, and fees vary based on the product and your qualifications
• You are responsible for repaying the funding according to the agreed-upon terms
• Early repayment options may be available depending on the funding product

7. Fees and Charges

All fees and charges associated with your funding will be clearly disclosed in your funding agreement before you sign. We do not charge application fees. Fees may include:

• Origination fees
• Processing fees
• Late payment fees (if applicable)
• NSF/returned payment fees (if applicable)

All fees will be detailed in your funding agreement. There are no hidden fees.

8. Representations and Warranties

By using our services, you represent and warrant that:

• You have the authority to bind the business to any funding agreement
• All information provided is accurate and complete
• Your business is in good standing and operating legally
• You will use the funding for legitimate business purposes
• You are not in bankruptcy or insolvency proceedings

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of SKYLINE FUNDING CAPITAL LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

To the fullest extent permitted by law, SKYLINE FUNDING CAPITAL LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount of fees you have actually paid to us.

11. Indemnification

You agree to indemnify, defend, and hold harmless SKYLINE FUNDING CAPITAL LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising out of or related to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Brooklyn, New York. You waive any right to a jury trial or to participate in a class action lawsuit.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
